AN ACT relative to a temporary moratorium on large groundwater permits and withdrawals.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Six

AN ACT relative to a temporary moratorium on large groundwater permits and withdrawals.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Moratorium on the Issue of Large Groundwater Withdrawal Permits. Notwithstanding any other law to the contrary, there is hereby established a moratorium on the issue of large groundwater withdrawal permits, which shall be in effect from the effective date of this act until 90 days after the date the commission to study issues relative to groundwater withdrawals, established by 2003, 305 and amended by 2005, 287, issues its final report.

2 Moratorium on Large Groundwater Withdrawals. Notwithstanding any other law to the contrary, there is hereby established a moratorium on large groundwater withdrawals, which shall apply to any holder of a large groundwater withdrawal permit who has not yet begun to withdraw water under the permit. The moratorium shall be in effect from the effective date of this act until 90 days after the date the commission to study issues relative to groundwater withdrawals, established by 2003, 305 and amended by 2005, 287, issues its final report.

3 Effective Date. This act shall take effect 60 days after its passage.
