STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Six

AN ACT establishing the New Hampshire civil war cannon restoration fund.

Be it Enacted by the Senate and House of Representatives in General Court convened:

244:1 New Subdivision; New Hampshire Civil War Cannon Restoration Fund. Amend RSA 110-B by inserting after section 79 the following new subdivision:

New Hampshire Civil War Cannon Restoration Fund

110-B:80 Civil War Cannon Restoration Fund. The adjutant general is authorized to accept gifts, grants, or donations, from any public or private source, for the purpose of restoring the New Hampshire civil war cannons. All such monetary grants, gifts, and donations shall be deposited in a special fund, which shall be established in the office of the state treasurer and known as the New Hampshire civil war cannon restoration fund. The fund shall be nonlapsing and shall be kept separate and distinct from all other funds. The fund shall be continually appropriated to the adjutant general and used solely for the restoration of state civil war cannons. The fund shall be organized exclusively for charitable and educational purposes, within the meaning of those terms as used in section 501(c)(3) of the Internal Revenue Code of 1986, as amended, and no part of the net earnings shall inure to the benefit of any individual.

244:2 New Subparagraph; State Treasurer; Application of Receipts; Civil War Memorials Fund Added. Amend RSA 6:12, I(b) by inserting after subparagraph (242) the following new subparagraph:

(243) Money received by the national guard for deposit in the New Hampshire civil war cannon restoration fund established in RSA 110-B:80.

244:3 Repeal. The following are repealed:

I. RSA 110-B:80, relative to the New Hampshire civil war cannon restoration fund.

II. RSA 6:12, I(b)(243), relative to the New Hampshire civil war cannon restoration fund.

244:4 Effective Date.

I. Section 3 of this act shall take effect July 1, 2010.

II. The remainder of this act shall take effect 60 days after its passage.

Effective: I. Section 3 shall take effect July 1, 2010.

II. Remainder effective July 31, 2006.
