STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Six

AN ACT establishing a legislative health care advisory board.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Chapter; Legislative Health Care Advisory Board. Amend RSA by inserting after chapter 18 the following new chapter:

CHAPTER 18-A

LEGISLATIVE HEALTH CARE ADVISORY BOARD

18-A:1 Advisory Board Established. There is established the legislative health care advisory board to evaluate pending legislation and advise the general court on matters related to such legislation. The purpose of the advisory board is to facilitate legislators in evaluating the impact of specific legislative proposals on the comprehensive health care and health insurance system.

18-A:2 Membership of the Legislative Health Care Advisory Board.

I. The members of the advisory board shall be as follows:

(a) The commissioner of health and human services or designee.

(b) The insurance commissioner, or designee.

(c) A representative of the New Hampshire Hospital Association.

(d) A representative of Endowment for Health.

(e) A representative of the New Hampshire Public Health Association.

(f) A representative of the Home Care Association of New Hampshire.

(g) A representative of the New Hampshire Health Care Association.

(h) A representative of the New Hampshire Medical Society.

(i) A representative of the New Hampshire Mental Health Counseling Association.

(j) A representative of the New Hampshire Dental Society.

(k) The executive director of New Hampshire Healthy Kids, or designee.

(l) A representative of the Business and Industries Association.

II. Members who are not serving ex officio shall be appointed by the respective organizations for 3-year terms. Members of the board shall serve without compensation.

III. The legislative health care advisory board shall select a chair from among its members.

IV. The advisory board may seek input or expertise from any person or organization for assistance in fulfilling its duties.

18-A:3 Meetings; Duties. The legislative health care advisory board shall meet at the request of the speaker of the house of representatives, the president of the senate, or a chairperson of any house of representatives or senate committee having jurisdiction over related subject matter for the purpose of examining any health care or health insurance proposal before the legislature or legislative committee. The board shall provide advice to the legislature or to the legislative committee on the health care and health insurance matters in such proposal, with specific attention to affordability, access to health care and health insurance, and quality of health care services.

2 Effective Date. This act shall take effect 60 days after its passage.
