STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Six

AN ACT relative to rates charged by health care providers.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Chapter; Health Care Provider Rates. Amend RSA by inserting after chapter 332-I the following new chapter:

CHAPTER 332-J

HEALTH CARE PROVIDER RATES

332-J:1 Health Care Provider Rates; Definition.

I. In this chapter, “health care provider” means any person, corporation, facility, or institution either licensed by this state or otherwise lawfully providing health care services, including, but not limited to, a physician, hospital or other health care facility, dentist, nurse, optometrist, podiatrist, physical therapist, or psychologist, and any officer, employee, or agent of such provider acting in the course and scope of employment or agency related to or supportive of health care services.

II. Notwithstanding any provision of law to the contrary, health care providers shall charge uninsured and underinsured persons their median rate charged by carriers who contract directly with the provider community to insured patients.

2 Effective Date. This act shall take effect 60 days after its passage.
