AN ACT relative to the return of replaced parts by a motor vehicle repair facility.

The bill requires a motor vehicle repair facility to return any replaced parts to the customer unless the customer has provided written notice that the parts need not be returned.

AN ACT relative to the return of replaced parts by a motor vehicle repair facility.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 Return of Replaced Parts; Mandatory Without Written Waiver by Customer. Amend RSA 358-D:9 to read as follows:
358-D:9 Return of Replaced Parts. With the exception of parts required to be returned to the manufacturer or distributor under a warranty or exchange agreement, all parts which have been replaced on a motor vehicle by a motor vehicle repair facility shall be returned to the customer [if the customer has requested, in advance of the work being performed, that the parts be returned to him] unless the customer signs a waiver or provides other written notice that the parts need not be returned.
2 Return of Replaced Parts. Amend RSA 358-D:11, VI to read as follows:
VI. The customer has a right to a return of all replaced parts, except those parts required to be returned to the manufacturer or distributor under a warranty or exchange agreement, [if he requests that they be returned to him prior to the service or repair work being performed] unless the customer signs a waiver or provides other written notice that the parts need not be returned;
3 Effective Date. This act shall take effect January 1, 2008.
