AN ACT relative to residency requirements for members appointed to historic district or heritage commissions.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Seven

AN ACT relative to residency requirements for members appointed to historic district or heritage commissions.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Historic Commission; Membership. Amend RSA 673:4, II to read as follows:

II. Each historic district commission member shall be a resident of the city or town which establishes the district except as provided in paragraph IV. One commission member shall be a member of the local governing body and one commission member may be a member of the planning board. Not more than 5 alternate members may be appointed. When an alternate sits in absence or disqualification of a regular member, the alternate shall have full voting powers. In determining each member’s qualifications, the appointing authority shall take into consideration the appointee’s demonstrated interest and ability to understand, appreciate and promote the purposes of the historic district commission.

2 New Paragraph; Non-Resident Membership. Amend RSA 673:4 by inserting after paragraph III the following new paragraph:

IV. One person who is not a resident of the municipality may be appointed to the commission if he or she is a property owner within the district, lives within the state of New Hampshire, and operates a business on that property in which he or she actively participates at last 75 percent of the year.

3 Heritage Commission; Membership. Amend RSA 673:4-a, II to read as follows:

II. Each heritage commission member shall be a resident of the city or town which establishes the commission except as provided in paragraph IV. One commission member shall be a member of the local governing body. One commission member may be a member of the planning board. Not more than 5 alternate members may be appointed. When an alternate sits in absence or disqualification of a regular member, the alternate shall have full voting powers. If there is a historic district commission, one member of this commission shall be an ex officio member of the heritage commission. In determining each member’s qualifications, the appointing authority shall take into consideration the appointee’s demonstrated interest and ability to understand, appreciate and promote the purpose of the heritage commission.

4 New Paragraph; Non-Resident Membership. Amend RSA 673:4-a by inserting after paragraph III the following new paragraph:

IV. One person who is not a resident of the municipality may be appointed to the commission if he or she is a property owner within the historic district, lives within the state of New Hampshire, and operates a business on that property in which he or she actively participates at last 75 percent of the year.

5 Effective Date. This act shall take effect 60 days after its passage.
