AN ACT relative to the amount of child support arrearage triggering the denial of a passport.

ANALYSIS

This bill changes a reference to the amount of a child support arrearage that may be used to deny a passport. The federal Deficit Reduction Act of 2005 reduced the amount from $5,000 to $2,500.

This bill is a request of the department of health and human services.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Seven

AN ACT relative to the amount of child support arrearage triggering the denial of a passport.

Be it Enacted by the Senate and House of Representatives in General Court convened:

34:1 Denial of Passports. Amend RSA 161-C:26-b, I to read as follows:

I. The department is authorized to certify to the United States Secretary of Health and Human Services, pursuant to section 652(k) of the Social Security Act, that an obligor owes child support arrearages in [an amount exceeding $5,000] the amount specified by the federal law and is out of compliance with a legal order of support.

34:2 Effective Date. This act shall take effect 60 days after its passage.
