AN ACT requiring notice of construction or expansion of a public school.

ANALYSIS

This bill requires the school board of any district to give written notice to the department of transportation of the new construction or expansion of a public school at least a year before the construction or expansion is completed.

This bill is a request of the department of transportation.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Seven

AN ACT requiring notice of construction or expansion of a public school.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Section; Notice of Construction or Expansion Required. Amend RSA 189 by inserting after section 1-e the following new section:

189:1-f New Construction or Expansion of a School.

I. The school board of any school district shall give written notice to the department of transportation of:

(a) The new construction of any school in the district; or

(b) The reconstruction or renovation of any school in the district that is anticipated to increase the number of students accommodated at the school by more than 10 percent.

II. The school board shall provide the notice required under paragraph I at least one year before the opening of a new school or the completion of the reconstruction or renovation of an existing school.

III. The school board shall take into account the possible increased highway and pedestrian traffic that could be generated by the new construction, reconstruction, or renovation and provide appropriate highway design and construction in the affected area.

IV. The department of transportation shall coordinate with the school board when implementing appropriate highway-related improvements that address the increase in highway and pedestrian traffic.

2 Effective Date. This act shall take effect 60 days after its passage.
