This bill allows for the basis for disciplinary proceedings referred to the medical review subcommittee under the board of medicine to be disclosed to other members of the subcommittee and the board of medicine.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Seven

AN ACT relative to disclosure of the basis for disciplinary proceedings among members of the board of medicine.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Physicians; Confidential Proceedings; Medical Review Subcommittee. Amend RSA 329:29 to read as follows:

329:29 Proceedings of Medical Review Committee. All proceedings, records, findings, and deliberations of medical review committees of a duly established county or state medical society or of any such committees of the board of medicine are confidential and privileged and shall not be used or available for use or subject to process in any other proceeding. The manner in which a medical review committee and each member thereof deliberates, decides, or votes on any matter submitted to it is likewise confidential and privileged and shall not be the subject of inquiry in any other proceeding. Provided, however, that members of the medical review subcommittee under RSA 329:17, V-a and the medical review administrator may disclose the basis for disciplinary proceedings referred to the medical review subcommittee with other members of such subcommittee and with the board. A medical review committee [may] shall provide information to a hospital committee organized to evaluate matters relating to the care and treatment of patients or to reduce morbidity and mortality, in accordance with RSA 151:13-a, and subject to the privileges and immunities set forth in that section.

2 Effective Date. This act shall take effect 60 days after its passage.
