STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Seven

AN ACT relative to the procurement of eggs and egg products by the state.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Section; Humane Egg Procurement. Amend RSA 21-I by inserting after section 12 the following new section:

21-I:12-a Humane Egg Procurement.

I. In this section:

(a) “Cage-free hen” means a female domesticated chicken, turkey, duck, goose, or guinea, which, other than being confined during the first 10 days of its life, during actual transport, or during the provision of individualized veterinary care by a licensed veterinarian, has never been confined for the majority of any day in a structure in which each bird does not have the ability to fully spread its wings without touching the sides of such enclosure or other birds.

(b) “Living space” means any cage, crate, or other structure used to confine caged egg-laying hens.

II. Notwithstanding any provision of law to the contrary, the director of plant and property management shall only purchase eggs produced by cage-free hens.

III. This section shall not apply to the confinement of caged egg-laying hens in such circumstances that may occur during county fair exhibition, transport, slaughter, or individualized veterinary care.

IV. The exemption described in RSA 21-I:18, I(d) shall not apply to the purchase of eggs as limited in this section.

2 Effective Date. This act shall take effect 60 days after its passage.
