ANALYSIS

This bill requires the pharmacist dispensing emergency contraception to inform the recipient regarding certain issues and to place a sign at each cash register in the pharmacy with a statement about fertilization.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Seven

AN ACT relative to certain notification for emergency contraception.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Emergency Contraception; Prerequisites to Sale. Amend RSA 318:47-e, II to read as follows:

II. A pharmacist may initiate emergency contraception drug therapy in accordance with standardized procedures or protocols developed by the board, adopted pursuant to RSA 541-A, and an authorized prescriber who is acting within his or her scope of practice. Before dispensing or distributing emergency contraception, a pharmacist shall:

(a) Require the person obtaining the drug to:

(1) Display a driver’s license or other form of identification containing the person’s photograph and indicating that the person is 18 years of age or older; and

(2) Acknowledge that the pharmacist provided the person obtaining the drug with the information required under this paragraph.

(b) Maintain each record made under this section.

2 Emergency Contraception; Duty to Inform. Amend RSA 318:47-e, IV to read as follows:

IV. For each emergency contraception drug therapy initiated pursuant to this section, the pharmacist shall provide each recipient of the emergency contraceptive drugs with a standardized fact sheet that includes, but is not limited to: the indications for the use of the drug, the appropriate method for using the drug, information on the importance of follow-up health care, and health care referral information. The board shall develop this fact sheet in consultation with the commissioner of the department of health and human services, the American College of Obstetricians and Gynecologists, and other relevant health care organizations. The pharmacist shall also inform the recipient orally and in writing that emergency contraception may prevent:

(a) The fertilization of an egg; or

(b) The implantation of a fertilized egg in the uterus.

3 New Paragraph; Emergency Contraception; Sign Required. Amend RSA 318:47-e by inserting after paragraph IV the following new paragraph:

IV-a. Any pharmacy where emergency contraception is dispensed or distributed shall display a sign, in clear view of each cash register in the pharmacy, that is at least 18 inches high by 24 inches wide, in block letters in a font that may be read clearly, in English and Spanish:

“IF YOU BELIEVE THAT LIFE BEGINS AT FERTILIZATION, THE POINT WHERE THE SPERM AND EGG UNITE, THEN YOU NEED TO KNOW THAT EMERGENCY CONTRACEPTION MAY EITHER FUNCTION AS A CONTRACEPTIVE TO PREVENT THE EGG AND SPERM FROM UNITING OR PREVENT THE IMPLANTATION OF YOUR ALREADY FERTILIZED EGG IN YOUR WOMB. THE PHARMACIST DISPENSING THIS DRUG IS REQUIRED TO EXPLAIN TO YOU HOW THE PRODUCT MAY HELP TO PREVENT YOUR PREGNANCY.”

4 Effective Date. This act shall take effect 60 days after its passage.
