STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Seven

AN ACT relative to work on Thanksgiving and Christmas Day.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Holiday Work. Amend RSA 275:28 to read as follows:

275:28 Holidays.

I. No employee shall be required to work in any mill or factory on any legal holiday, except to perform such work as is both absolutely necessary and can lawfully be performed on the Lord’s Day.

II.(a) Except as provided in subparagraph (b), no person other than a volunteer may be required to work on Thanksgiving or Christmas Day.

(b) The provisions of subparagraph (a) shall not apply to law enforcement, emergency response, emergency medical personnel, or any other personnel classified as essential emergency personnel by law or by the local legislative body.

2 Effective Date. This act shall take effect 60 days after its passage.

366-FN - FISCAL NOTE

AN ACT relative to work on Thanksgiving and Christmas Day.

FISCAL IMPACT:

      The Association of Counties and Municipal Association state this bill may increase county and local expenditures by an indeterminable amount in fiscal year 2008 and each fiscal year thereafter. There will be no fiscal impact on state, county, and local revenue or state expenditures.

METHODOLOGY:

    The Municipal Association states that this bill prohibits any person other than a volunteer from being required to work on Thanksgiving or Christmas Day, with the exception of law enforcement, emergency response or emergency medical personnel, or any other personnel classified as essential emergency personnel by law or by a local legislative body. The Association is unable to determine the fiscal impact of this bill as it does not know whether any municipalities require employees, other than those specifically excluded from the bill’s provisions, to work on Thanksgiving or Christmas Day. To the extent that municipalities do require such work, they may incur costs to make other arrangements.

    The Association of Counties states this bill may increase county expenditures, particularly as it impacts the nursing homes and county corrections facilities.

    The Department of Administrative Services states this bill will have no fiscal impact on state funds. Terms and conditions of employment are negotiated for state employees under RSA 273-A, not RSA 275. Any change in schedules or requirements for state employees to work on certain days would need to be negotiated with the unions representing state employees as part of the collective bargaining process.
