AN ACT relative to mosquito control districts.

ANALYSIS

This bill clarifies that a mosquito control district established under RSA 430:13 may apply for moneys from the mosquito control fund. This bill also repeals the exemption from the permitting and registration requirements for application of pesticides for expedited mosquito control and abatement activities pursuant to a declared threat to the public health.

This bill is a request of the department of health and human services.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Seven

AN ACT relative to mosquito control districts.

Be it Enacted by the Senate and House of Representatives in General Court convened:

22:1 Mosquito Control Districts. Amend RSA 141-C:24 to read as follows:

141-C:24 Mosquito Control Districts; Rulemaking. Contiguous municipalities may establish mosquito control districts for the purposes of applying for moneys from the mosquito control fund established in RSA 141-C:25 and for the purposes of applying for spraying permits. The commissioner, in consultation with the commissioner of the department of agriculture, markets, and food shall adopt rules, pursuant to RSA 541-A, relative to the establishment of such mosquito districts. A mosquito control district established pursuant to RSA 430:13 shall be considered a mosquito control district under this chapter.

22:2 Repeal. RSA 430:46, I(e), relative to an exemption for a declared threat to the public health, is repealed.

22:3 Effective Date. This act shall take effect 60 days after its passage.
