STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Seven

AN ACT prohibiting the intensive confinement of caged egg-laying hens.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Subdivision; Caging Conditions of Egg-Laying Hens. Amend RSA 435 by inserting after section 40 the following new subdivision:

Caging Conditions of Egg-Laying Hens

435:41 Intensive Confinement of Caged Egg-laying Hens Prohibited.

I. “Egg-laying hen” means a female domesticated chicken, turkey, duck, goose, or guinea used for the purpose of egg production.

II. “Living space” means any cage, crate, or other structure used to confine caged egg-laying hens.

III. No person, natural or otherwise, may confine any caged egg-laying hen to a living space that does not allow the hen sufficient space to fully extend all its limbs without touching the sides of the living space, except as provided in paragraph IV.

IV. This section shall not apply to the confinement of caged egg-laying hens in such circumstances that may occur during county fair exhibition, transport, slaughter, or individualized veterinary care.

V. Whoever willfully violates this section shall be fined not less than $200 and not more than $500. Each day’s violation shall be considered a separate offense.

2 Effective Date. This act shall take effect January 1, 2008.
