This bill permits a creditor to request that a state agency refuse to renew a debtor’s motor vehicle, occupational, or recreational license or permit until the judgment is paid in full.

STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Seven
AN ACT relative to the collection of judgments.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 New Subdivision; Nonrenewal of Licenses. Amend RSA 358-C by inserting after section 5 the following new subdivision:
358-C:6 Collections; Nonrenewal of Licenses.
I. If a person defaults on a final, court-ordered judgment relative to an outstanding debt, the creditor may file a copy of the judgment with one appropriate agency and request that the agency deny renewal of any motor vehicle, occupational, or recreational license or permit held by the debtor until the judgment is paid in full.
II. Upon receipt of a request for nonrenewal, the licensing agency shall provide written notice to the debtor of the agency’s intention not to renew the debtor’s license or permit. The notice of nonrenewal shall include the grounds for nonrenewal and shall inform the debtor of his or her right to contest the agency’s action by requesting an administrative due process hearing under RSA 541-A. The scope of a hearing under this section shall be limited to mistake of fact and whether the debtor is in compliance with the judgment.
III. The agency shall not renew the debtor’s license or permit until the debtor pays the full amount of the judgment to the agency. The agency may retain 5 percent of the outstanding judgment as payment of administrative costs incurred by the agency in the nonrenewal process and shall forward the remainder to the creditor.
2 Effective Date. This act shall take effect January 1, 2008.
