STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Seven

AN ACT relative to the duties of probation and parole officers.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Probationers and Parolees; Powers and Duties. Amend RSA 504-A:12, II to read as follows:

II. To take charge of and to provide supervision to persons placed on probation, parole, or lifetime supervision, attempting to assist them with their rehabilitation needs, to assist them in establishing law-abiding lives while monitoring their behavior through office, home, work, and other contacts to insure that they comply with their probation, parole, or lifetime supervision conditions; to be knowledgeable and responsible for assisting offenders with mental and physical disabilities, and drug treatment, relapse, and addiction problems using case management training techniques.

2 Probationers and Parolees; Supervision by the Commissioner. Amend RSA 504-A:9 to read as follows:

504-A:9 Supervision by the Commissioner. The commissioner shall exercise technical supervision over probation and parole officers in the state. The commissioner shall require probation and parole officers to undergo case management training, including training in motivational counseling and interviewing techniques, to better enable them to assist offenders with mental health disabilities, and drug treatment and rehabilitation needs.

3 Effective Date. This act shall take effect 60 days after its passage.

FISCAL IMPACT:

    The Office of Legislative Budget Assistant is unable to complete a fiscal note for this bill as it is awaiting information from the Department of Corrections. When completed, the fiscal note will be forwarded to the House Clerk's Office.
