AN ACT relative to child support enforcement.

ANALYSIS

This bill establishes the circumstances under which the department is required to collect a fee for child support enforcement services and those under which the department may collect such a fee.

This bill is a request of the department of health and human services.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Seven

AN ACT relative to child support enforcement.

Be it Enacted by the Senate and House of Representatives in General Court convened:

148:1 Duty of Department to Enforce Child Support; Fee. Amend RSA 161-B:3, IV to read as follows:

IV. In cases where the department is providing child support services to an individual who has never received assistance under a state program funded under Title IV-A of the Social Security Act, the commissioner shall charge a fee in accordance with section 454(6) of the Social Security Act. In all other cases where the department is providing child support services, the commissioner may charge a fee to compensate the department for services rendered in establishment of or enforcement of support obligations. [The commissioner may by regulation establish reasonable fees for support enforcement services and may, on showing of necessity, waive or defer any such fee.]

148:2 Effective Date. This act shall take effect 60 days after its passage.
