HB 613 FISCAL NOTE

AN ACT relative to payment for tobacco products purchased by retailers.

FISCAL IMPACT:

The Department of Revenue states this bill will increase state general fund expenditures and may decrease state revenue by an indeterminable amount in FY 2008 and each year thereafter. There will be no fiscal impact on county and local expenditures or revenue.

METHODOLOGY:

The Department of Revenue states this bill requires retailers to pay wholesalers for the cost of tobacco products purchased within 10 days of such purchase. This bill would be difficult to administer because wholesalers would need to report their unpaid retailers to the Department. The Department would have to suspend and revoke licenses for retailers who do not pay within the 10 days, attend hearings, and reinstate licenses on a daily basis. The process would be cumbersome and costly for the Department. The Department also states this bill may diminish the sales of tobacco products and have an impact on business due to cash flow.
