STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Seven

AN ACT exempting certain persons age 65 and older from 25 percent of the state and local education portion of property taxes.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Section; Education Taxes Exemption; Persons Age 65 and Older. Amend RSA 72 by inserting after section 42 the following new section:

72:42-a Education Tax Exemption; Persons Age 65 and Older. Any person who is age 65 or older and has no children enrolled in the public schools, upon application to the selectmen or assessor, shall be exempt from payment of 25 percent of the portion of property taxes designated for state education and local education. The exemption shall apply only to the person’s primary residence.

2 Interpretation and Rules; Reference Added. Amend RSA 72:43, I(a) to read as follows:

(a) [His] The commissioner’s interpretation and construction of RSA 72:39-a, RSA 72:39-b, [and] RSA 72:41, and RSA 72:42-a; and

3 Effective Date. This act shall take effect April 1, 2007.

HB 616 FISCAL NOTE

AN ACT exempting certain persons age 65 and older from 25 percent of the state and local education portion of property taxes.

FISCAL IMPACT:

      The NH Municipal Association states this bill will increase local expenditures by an indeterminable amount in FY 2007 and each fiscal year thereafter. There will be no fiscal impact on state, county, and local revenue or state and county expenditures.

METHODOLOGY:

    The Department of Revenue Administration states it could administer this bill within its existing budget. The Department and the NH Municipal Association state this bill shifts the burden of state and local education property taxes among local taxpayers, without affecting the total amount of revenue received from the taxes at the state and local levels. The NH Municipal Association states this bill will increase local expenditures by an indeterminable amount to administer this bill, which includes costs to reprogram tax collection software and to process exemptions.
