STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Seven

AN ACT requiring notice to the public of a change in land use subject to the assessment of the land use change tax.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Paragraph; Notice of Change of Land Use. Amend RSA 79-A:7 by inserting after paragraph VII the following new paragraph:

VIII. Upon receipt of the notice from the owner required under paragraph VII, the local assessing officials shall post notice of the change of land use and the procedures for appealing such change in land use, in 2 public places in the town, city, or county in which the land is located and in 2 newspapers which are widely circulated in such town, city, or county.

2 Effective Date. This act shall take effect 60 days after its passage.

HB 645 FISCAL NOTE

AN ACT requiring notice to the public of a change in land use subject to the assessment of the land use change tax.

FISCAL IMPACT:

      The Department of Revenue and the New Hampshire Municipal Association state this bill will increase local expenditures by an indeterminable amount in FY 2007 and each year thereafter. There will be no fiscal impact on state and county expenditures or state, county, and local revenue.

METHODOLOGY:

    The Department of Revenue Administration and New Hampshire Municipal Association state this bill will require public notice and posting of a change in land use and procedures for appealing such change. The increase in expenditures will depend on the number of land use change notices received by a municipality and the cost to post and publish the land use change. The Association states unless the landowner is charged the costs associated with this bill, the bill will mandate additional expenditures by municipalities in violation of Article 28-a of the New Hampshire Constitution.
