STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Seven

AN ACT relative to an assistant state veterinarian.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Paragraph; Assistant State Veterinarian. Amend RSA 436:8 to read as follows:

436:8 Powers.

I. The state veterinarian, under the direction of the commissioner, shall have all of the powers of the commissioner and shall have general charge of the enforcement of this chapter, and shall devote his entire time and attention to the duties of his office. The state veterinarian shall have the power to enforce the provisions of and investigate complaints under RSA 644:8, 644:8-a, 644:8-aa and any other law pertaining to the abuse of domestic animals, as defined under RSA 436:1. In the event the commissioner becomes incapacitated or a vacancy occurs in the office, the state veterinarian shall perform all the duties of that office during any such incapacity or until any such vacancy is filled. The commissioner may direct the state veterinarian to act for him in an official capacity whenever he may be absent from his duties.

II. The state veterinarian may appoint an assistant state veterinarian, within the limits of the appropriation made for the department of agriculture, markets, and food, who shall serve at the pleasure of the state veterinarian. The assistant state veterinarian shall be an unclassified employee.

2 Assistant State Veterinarian; Salary. The salary for the unclassified position authorized in section 1 of this act shall be established as provided in RSA 14:14-c, RSA 17-A:7, and RSA 94:1-d.

3 Effective Date. This act shall take effect July 1, 2007.

HB 660-FN - FISCAL NOTE

AN ACT relative to an assistant state veterinarian.

FISCAL IMPACT:

      The Department of Agriculture, Markets, and Food states this bill will increase state general fund expenditures by $121,596 in FY 2008, $106,596 in FY 2009 and each year thereafter. This bill has no fiscal impact on county and local expenditures or state, county, and local revenue.

METHODOLOGY:

      The Department of Agriculture, Markets, and Food states this bill will establish the position and salary of the assistant state veterinarian. The Department expects the assistant state veterinarian position will be an unclassified position at Group EE, maximum in order to have a competitive salary around $70,000. The Department states this salary is competitive with salaries for assistant veterinarians in other states. This bill does not appropriate funds for this position.

    The Department states with the addition of an assistant state veterinarian, animal health and emergency response capabilities would improve as duties are shared by the state veterinarian and the assistant state veterinarian. Additionally, existing animal health programs could be expanded thereby enhancing the value of livestock, their levels of productivity, and their products.
