STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Seven

AN ACT exempting vehicles adapted for use by persons with disabilities from motor vehicle registration fees.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Paragraph; Registration Fees; Exemptions. Amend RSA 261:141 by inserting after paragraph VIII the following new subparagraph:

VIII-a. No fee shall be charged for registering a vehicle which is to be used by and is necessary for the transportation of a person with a permanent and total disability, as qualified by the Social Security Administration, and which has been specially modified or adapted to accommodate the person’s disability, if the vehicle is owned or leased by the disabled person, a member of the disabled person’s family, or a trust established for the disabled person.

2 New Section; Municipal Permits for Registration; Exemption for Vehicles Used by Persons with Disabilities. Amend RSA 261 by inserting after section 157-a the following new section:

261:157-b Exemption for Vehicles Used by Persons with Disabilities. No fee shall be charged for a permit to register a motor vehicle which is to be used by and is necessary for the transportation of a person with a permanent and total disability, as qualified by the Social Security Administration, and which has been specially modified or adapted to accommodate the person’s disability, if the vehicle is owned or leased by the disabled person, a member of the disabled person’s family, or a trust established for the disabled person.

3 Effective Date. This act shall take effect July 1, 2007.

HB 662-FN-A-LOCAL - FISCAL NOTE

AN ACT exempting vehicles adapted for use by persons with disabilities from motor vehicle registration fees.

FISCAL IMPACT:

      The Department of Safety has determined this bill may decrease highway fund and local revenue and increase highway fund expenditures by an indeterminable amount in fiscal year 2008 and each year thereafter. There will be no fiscal impact on county revenue or county and local expenditures.

METHODOLOGY:

    The Department of safety states this bill exempts certain vehicles related to transportation of persons with disabilities from registration. The Department states there is no way to determine how many registrations currently with disability designation would be exempted by the provisions of the bill. Although it cannot be estimated, there would be a loss to highway fund revenue since each of these registrations would no longer be required to pay a registration fee. There would be an indeterminable fiscal impact on highway fund expenditures. Expenditures for local highway aid would decrease by 12% of the amount of decrease in revenue. However, there may be a cost to the Department to determine which vehicles are subject to this legislation and whether special inspections on these vehicles would need to be made, which would increase highway fund expenditures.
