This bill requires that retail gasoline and diesel fuel prices be set at the nearest cent per gallon. The bill also increases the road toll by .1 cent per gallon of motor fuel.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Seven

AN ACT relative to full cent gas pricing and road tolls.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Gasoline and Diesel Fuel Prices; Full Cent Pricing Required. Amend RSA 339:30-a to read as follows:

339:30-a Gasoline and Diesel Fuel Prices.

I. All persons who shall offer for sale or sell any gasoline or diesel fuel at retail shall post the price of all grades of such gasoline or diesel fuel on the pump from which such fuels are dispensed. Such posted prices shall be in numerals not less than 4 inches high and 3/4 of an inch in width. [Numerals indicating fractions or portions of whole numbers on any posted price shall be at least 1/2 the size of the whole number on such display, and] All posted prices shall reflect the total price of such fuel, including all taxes thereon. All posted prices shall be clearly visible from both sides of the pump from either direction of a motorist’s approach to the pump in a normal approaching manner for fuel.

I-a. The retail price for all grades of gasoline or diesel fuel sold or offered for sale in this state shall be set at the nearest cent per gallon.

II. Any person who shall violate the provisions of this section shall be guilty of a violation.

2 Sale of Liquid Fuels; Gasoline Sales. Amend RSA 339-B:8, I to read as follows:

I. Display, or allow to be displayed on [his] the premises, any sign, placard, or other advertisement relating to the retail price of gasoline unless [numerals thereon indicating fractions or portions of a whole number are at least half the size of the largest whole number on such sign, and no such price of gasoline shall be advertised without the tax included] the price advertised reflects the total price for such fuel, including all taxes.

3 Road Tolls; Levy of Tolls and Exemptions. Amend the introductory paragraph of RSA 260:32 to read as follows:

260:32 Levy of Tolls and Exemptions. There is hereby imposed a road toll of [$.18] $.181 per gallon upon the sale of each gallon of motor fuel sold by distributors thereof. The road toll shall be collected by the distributor from the purchaser and remitted to the state in the manner hereinafter set forth. Provided, that the road toll shall not apply to:

HB 681-FN-A - FISCAL NOTE

AN ACT relative to full cent gas pricing and road tolls.

FISCAL IMPACT:

      The Department of Safety indicates this bill will increase state highway revenue by $830,000 in FY 2008 and each year thereafter, and increase state highway expenditures and local revenue by $99,600 in FY 2009 and each year thereafter. There is no fiscal impact on county and local expenditures or county revenue.

METHODOLOGY:

    The Department states this bill increases the gasoline road toll rate by one-tenth of a cent per gallon of motor fuel and requires that retail gasoline and diesel fuel prices be set at the nearest cent per gallon. The Department calculates state highway fund revenue will increase by $830,000 per year beginning in FY 2008 and each year thereafter. The Department further assumes this rate change will increase state highway expenditures and local revenues by $99,600 per year beginning in FY 2009 and each year thereafter. The local revenue increase represents the 12% local government apportionment that the Department of Transportation distributes based on the preceding fiscal year revenues in accordance with RSA 235:23.
