AN ACT establishing a commission to study issues relative to the practice of leasing state-owned real estate on the shores of public waters.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Seven

AN ACT establishing a commission to study issues relative to the practice of leasing state-owned real estate on the shores of public waters.

Be it Enacted by the Senate and House of Representatives in General Court convened:

254:1 Commission Established. There is established a commission to study issues relative to the practice of leasing state-owned real estate on the shores of public waters.

254:2 Membership and Compensation.

I. The members of the commission shall be as follows:

(a) Two members of the house of representatives, appointed by the speaker of the house of representatives.

(b) One member of the senate, appointed by the president of the senate.

(c) One representative from the council on resources and development.

(d) One representative from the lakes management advisory committee.

(e) One representative from the rivers management advisory committee.

(f) One representative from the public water access advisory board.

(g) One representative from the fish and game department.

(h) One representative from the department of environmental services.

(i) One representative from the department of resources and economic development.

(j) One representative from the department of transportation.

(k) One representative from the New Hampshire housing finance authority.

(l) Two members of the public, appointed by the governor.

(m) One representative from the department of safety.

(n) One representative from the long range capital planning and utilization committee.

(o) One representative of a municipality with leased shorefront property, appointed by the New Hampshire Municipal Association.

(p) One representative of current lessees under RSA 228:57-a, appointed by the commissioner of transportation.

II. Legislative members of the commission shall receive mileage at the legislative rate when attending to the duties of the commission.

254:3 Duties. The commission shall:

I. Review data calculating the total shorefront length of state-owned real estate on the shores of public waters, by town; the shorefront length of state-owned real estate available to be leased; the hydrological characteristics of the real estate available to be leased; and the income generated by and uses made of any such leases during the prior 5 years.

II. Review state agency policies that establish the prices at which state-owned real estate on the shores of public waters may be leased.

III. Assess the effects that leasing state-owned real estate on the shores of public waters has on water quality.

IV. Assess the effects that leasing state-owned real estate on the shores of public waters has on public drinking water supplies.

V. Assess the effects that leasing state-owned real estate on the shores of public waters has on public access.

VI. Review current leasing practices for state-owned real estate on the shores of public waters for consistency with statutes, including RSA 483, RSA 483-A, and RSA 483-B.

VII. Review statutes relating to leasing of state-owned property, including RSA 4:40, RSA 228:31, and RSA 228:57-a, and recommend amendments to the statutes as necessary.

254:4 Chairperson; Quorum. The members of the study commission shall elect a chairperson from among the members. The first meeting of the commission shall be called by the first-named house member. The first meeting of the commission shall be held within 45 days of the effective date of this section. Nine members of the commission shall constitute a quorum.

254:5 Report. The commission shall report its findings and any recommendations for proposed legislation in an interim report to the chairman of the long range capital planning and utilization committee, the speaker of the house of representatives, the president of the senate, the house clerk, the senate clerk, the governor, the commissioner of transportation, the commissioner of environmental services, the director of the office of energy and planning, and the state library on or before November 1, 2007. The commission shall report its findings and any recommendations for proposed legislation in a final report to the chairman of the long range capital planning and utilization committee, the speaker of the house of representatives, the president of the senate, the house clerk, the senate clerk, the governor, the commissioner of transportation, the commissioner of environmental services, the director of the office of energy and planning, and the state library on or before November 1, 2008.

254:6 Effective Date. This act shall take effect upon its passage.
