STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Seven

AN ACT establishing land and community heritage investment program number plates.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Subdivision; Land and Community Heritage Investment Program Number Plates. Amend RSA 261 by inserting after section 97-f the following new subdivision:

Land and Community Heritage Investment Program Number Plates

261:97-g Land and Community Heritage Investment Program Number Plates.

I. The director is hereby authorized to issue special land and community heritage investment program number plates, in lieu of other number plates. The commissioner shall determine the design of these special plates, which shall include the phrase “Conserve New Hampshire.” The plates shall retain the “live free or die’’ motto.

II. Such plates shall be issued only upon application and upon payment of a fee established in this paragraph that shall be in addition to the regular motor vehicle registration fee and any other number plate fees otherwise required. The fee shall be based on the registration number represented on the plate as follows: for plates with numbers from 1 to 999 - $1,000 for the first year and $1,250 for each subsequent year; for plates with numbers from 1,000 to 9,999 - $250; for plates with numbers 10,000 and higher--$100; for vanity plates--$250 in addition to the fees for vanity plates which are otherwise established by law. The vanity plate portion of the fee shall be distributed as provided in RSA 261:89 and RSA 263:52.

III. Plates shall be renewed on an annual basis for the fee established in paragraph II. Of this sum, the department shall retain an amount as is necessary to recover production and administrative costs as approved by the fiscal committee of the general court. The remaining funds shall be paid to the state treasurer and deposited in the trust fund for the New Hampshire land and community heritage investment program established in RSA 227-M:7. The cost of replacement number plates shall be identical to the cost of initial number plates and the revenue from replacement number plates shall be distributed in the same manner as revenue derived from initial number plates.

IV. Plates may be used on passenger motor vehicles and recreation vehicles.

2 Effective Date. This act shall take effect July 1, 2007.

HB 726 FISCAL NOTE

AN ACT establishing land and community heritage investment program number plates.

FISCAL IMPACT:

      The Department of Safety and the Land and Community Heritage Investment Program (LCHIP) state this bill may increase state and local revenue and state expenditures by an indeterminable amount in fiscal year 2008 and each year thereafter. There will be no fiscal impact on county revenue or county and local expenditures.

METHODOLOGY:

    The Department of Safety states this bill establishes an LCHIP license plate. The plate fee schedule is as follows:

    Plate Number Initial Fee Renewal Fee

    1 – 999 $1,000 $1,250

    1,000 – 9,999 $250 $250

    10,000 or higher $100 $100

    Vanity $250 $250

    These fees are in addition to the regular registration fees and any other number plate fees otherwise required. The amount of additional revenue that will result from sales of LCHIP Plates can not be determined as the Department can not estimate how many people would buy such plates and of that total how many would be purchased from each fee category. Additional fee revenue would be allocated to the LCHIP Fund net of any production and administrative costs related to the plates. The portion of the fee equal to production and registration costs will be retained by the Department and deposited in the highway fund. Any increase in highway fund revenue will result in a 12% increase in highway fund expenditures for local highway aid.

    LCHIP states this bill may increase Program revenue by an indeterminable amount in fiscal year 2008 and each year thereafter, depending on the number of plates sold from each fee category. Any increase in revenue would directly impact the ability of the program to make matching grants.
