AN ACT relative to the use of secret databases.

This bill prohibits any public or private entity from using a secret database that contains personally identifiable information and does not provide the person an opportunity to review the accuracy of such information.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Seven

AN ACT relative to the use of secret databases.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Section; Information Practices Act; Use of Secret Databases Prohibited. Amend RSA 7-A by inserting after section 5 the following new section:

7-A:6 Secret Databases Prohibited. No New Hampshire person or entity, whether for profit or not for profit, including without limitation the state, its subdivisions, and agencies, shall use or possess, directly or indirectly, for any purpose, including without limitation hiring, contracting, licensing, banking, contract, and credit decisions, any information contained in a database created, maintained, or possessed by the federal government or the state government, or any agency of either, which:

I. Contains information relating to identifiable individuals; and

II. Allows access to that information in a way that individuals are identified but where the identifiable individual is not allowed to have access to and challenge the accuracy of that information in a public forum.

2 Effective Date. This act shall take effect 60 days after its passage.
