STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Seven

AN ACT relative to biodiesel road toll revenue.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Subparagraph; General Revenue Exceptions. Amend RSA 6:12, I(b) by inserting after subparagraph (252) the following new subparagraph:

(253) Money deposited in the biodiesel development fund established in RSA 260:61-a.

2 New Section; Off-Road Biodiesel Revenue. Amend RSA 260 by inserting after section 61 the following new section:

260:61-a Off-Road Biodiesel Revenue. The road toll administrator shall annually estimate the road toll paid on biodiesel used for off-road purposes and report the estimate to the treasurer. The treasurer shall credit the amount reported to the biodiesel development fund, which is hereby established as a nonlapsing fund continually appropriated to the department of environmental services for the purpose of funding biodiesel development activities authorized by statute.

3 Effective Date. This act shall take effect July 1, 2007.

HB 751-FN-A - FISCAL NOTE

AN ACT relative to biodiesel road toll revenue.

FISCAL IMPACT:

      The Departments of Safety and Environmental Services state this bill will decrease state highway fund revenue and expenditures, increase state restricted revenue and expenditures and decrease local revenue by an indeterminable amount in FY 2008 and each year thereafter. There will be no fiscal impact on county and local expenditures or county revenues.

METHODOLOGY:

    The Departments of Safety and Environmental Services state this bill requires the road toll administrator to estimate the road toll paid on biodiesel used for off-road purposes and pay that amount into a biodiesel development fund. The Department of Safety (DOS) does not currently track biodiesel blends separately, nor does DOS have data on the amount of fuel for which road toll has been paid and a road toll refund has not been requested. Therefore, under the current system it is not possible to estimate the amount of biodiesel used for off-road purposes. DOS, however, indicates state highway fund revenue will decrease and state restricted revenue will increase since a portion road toll tax will be credited in the biodiesel development fund instead of the highway fund. Further this decrease in highway revenue will decrease highway expenditures and local revenue for the 12% local government apportionment that the Department of Transportation distributes based on the preceding fiscal year revenues in accordance with RSA 235:23.

    The Department of Environmental Services (DES) estimates the increase in expenditures from the biodiesel development fund will be dependent on how complex the activities authorized by statute will be. Simple programs can be implemented using existing staff; more complex programs will increase restricted expenditures for additional staff that are not established in this bill.
