STATE OF NEW HAMPSHIRE

AN ACT relative to transfers of motor vehicle permits.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Refunds. RSA 261:151 is repealed and reenacted to read as follows:

261:151 Refunds.

I. If a person transfers or loses a registered vehicle, upon filing a new application for registration in his or her name, if the permit fee of the newly registered vehicle is less than the one first registered by him or her, he or she shall receive a refund for the difference.

II. If the department acting under the authority of law shall have refused upon original application for the registration period to register the vehicle to which a permit relates, the town clerk, upon application therefor, shall refund the permit fee.

2 Effective Date. This act shall take effect July 1, 2007.

HB 755 FISCAL NOTE

AN ACT relative to transfers of motor vehicle permits.

FISCAL IMPACT:

      The Department of Safety states this bill, as amended by the House (Amendment #2007-0892h), will decrease state and local revenue by an indeterminable amount, and have an indeterminable fiscal impact on state expenditures in FY 2008 and each year thereafter. This bill will have no fiscal impact on county and local expenditures, or county revenue.

METHODOLOGY:

    The Department of Safety states this bill would allow a person who transfers the registration of his or her vehicle to receive a refund if the total of the registration and permit fees for the new motor vehicle is less than the registration fee for the previously registered vehicle. The Department is unable to estimate the potential reduction in state highway fund revenue because it has no method to determine which transfers would result in refunds to the registrants or the dollar amounts of those refunds. The Department estimates they would need to fund an additional 250 hours of computer programming at a cost of $37,500 (250 hours at $150 per hour), and one additional Cash Terminal Operator I (LG 11) position with salary and benefits (calculated at 48.3%) of $33,286, current expense of $2,000, and equipment cost of $300 for a total cost of $73,086 in FY 2008. Expenses in FY 2009 and each year thereafter would only be salary and benefits with step increases and current expenses. State highway fund expenditures and local revenues for local highway aid would decrease by 12% of the decrease in highway fund revenue pursuant to RSA 235:23. The Department is unable to estimate the exact fiscal impact at this time.
