AN ACT relative to access to toilet facilities in public places.

ANALYSIS

This bill provides that places of public accommodation and certain other buildings that are equipped with toilet facilities shall make such facilities available to the public in an emergency.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Seven

AN ACT relative to access to toilet facilities in public places.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Toilet Facilities for Public Accommodations and Certain Other Buildings. Amend the subdivision heading preceding 155:40 to read as follows:

Access to Toilet Facilities [Where Food is Served]

2 New Section; Toilet Facilities in Places of Public Accommodation and Certain Buildings and Facilities. Amend RSA 155 by inserting after section 40 the following new section:

155:40-a Toilet Facilities in Places of Public Accommodation and Certain Buildings and Facilities. All places of public accommodation and buildings and facilities, as defined by RSA 275-C:10, II, that are equipped with toilet and lavatory facilities shall allow the public to use such facilities in an emergency.

3 Reference Change. Amend RSA 155:41 to read as follows:

155:41 Penalty for Failure to Provide. Any person who violates any of the provisions of [this subdivision] RSA 155:40 shall be guilty of a violation if a natural person, or guilty of a misdemeanor if any other person. From 10 days after the date of a conviction hereunder, each subsequent day of failure to comply shall constitute a separate and distinct offense.

4 Effective Date. This act shall take effect 60 days after its passage.
