AN ACT transferring certain land in the town of Stoddard from the Trust for Public Land to the fish and game department.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Seven

AN ACT transferring certain land in the town of Stoddard from the Trust for Public Land to the fish and game department.

Be it Enacted by the Senate and House of Representatives in General Court convened:

38:1 New Subparagraph; Water Management and Protection; Dams, Mills, and Flowage; Acquisition Authorized; Department of Fish and Game. Amend RSA 482:49, III by inserting after subparagraph (c) the following new subparagraph:

(d) The outlet dam, water rights, and 2.5 acre car-top boat launch access area at Robb Reservoir in the town of Stoddard, Cheshire county.

38:2 Contingency of Acceptance. Acceptance of the dam, water rights, and boat launch access area, as provided in section 1 of this act, shall be contingent on the following:

I. A finding by the department of environmental services and the fish and game department that the dam and associated boat launch property are in a reasonable and acceptable state of repair.

II. Acceptance by the fish and game department of one or more easements for maintenance of and public access to the dam and boat launch and public parking area.

III. All parcels to be conveyed shall be free of encumbrances, liens, mortgages, and unpaid taxes, and shall be deemed to have clear and marketable title; and a survey shall be prepared by a licensed land surveyor, and shall be suitable for recording at the appropriate county registry of deeds. Prior to final conveyance, all documents shall be reviewed and approved by the fish and game department.

IV. Acceptance by the state of New Hampshire, acting through the fish and game department, of fee simple interest in approximately 2.5 acres, in and around the Robb Reservoir dam for reasonable public access, swimming, fishing, hunting, and non-motorized, carry-in, boat access including canoes, kayaks, inflatable rafts, and similar vessels.

38:3 Effective Date. This act shall take effect 60 days after its passage.
