STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Seven

AN ACT relative to the deputy commissioner of the department of employment security.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Deputy Commissioner of Employment Security; Selection. Amend RSA 282-A:109 to read as follows:

282-A:109 Deputy Commissioner. [There shall be] The commissioner, with the approval of the governor and council shall appoint a deputy commissioner of the department of employment security who shall serve at the pleasure of the commissioner and shall act as commissioner whenever the commissioner of the department of employment security is incapacitated, absent or unable to act for any cause. The deputy commissioner shall also act as commissioner of the department of employment security until a new commissioner is duly appointed whenever there is no commissioner. [During such period as the deputy commissioner acts as commissioner, his status as a classified state employee shall continue and shall in no way be altered, affected or changed.] The deputy commissioner shall be an unclassified state employee.

2 Deputy Commissioner of Employment Security; Salary. The salary for the unclassified position authorized in section 1 of this act shall be established as provided in RSA 14:14-c, RSA 17-A:7, and RSA 94:1-d.

3 Unemployment Compensation Bureau, Employment Service Bureau and Economic and Labor Market Information Bureau; Administrators. Amend RSA 282-a:113, I to read as follows:

I. There shall be in the department of employment security 3 coordinate bureaus, the employment service bureau, the unemployment compensation bureau, and an economic and labor market information bureau, each of which shall be administered by a full-time salaried administrator who shall be subject to the supervision and direction of the commissioner of the department of employment security. Each bureau administrator shall be appointed by the commissioner, with the approval of the governor and council. The 3 bureau administrators shall be classified state employees. Each bureau shall be responsible for the discharge of its distinctive functions. Each bureau shall be a separate administrative unit with respect to personnel, budget, and duties except so far as the commissioner of the department of employment security may find such separation is impractical.

4 Administrators of Unemployment Compensation Bureau, Employment Service Bureau, and Economic and Labor Market Information Bureau; Salaries. The salaries for the unclassified positions authorized in section 3 of this act shall be established as provided in RSA 14:14-c, RSA 17-A:7, and RSA 94:1-d.

5 Effective Date. This act shall take effect July 1, 2007.

HB 885 FISCAL NOTE

AN ACT relative to the deputy commissioner of the department of employment security.

FISCAL IMPACT:

      The Department of Administrative Services and Department of Employment Security have determined this bill may have an indeterminable impact on state expenditures fiscal year 2008 and each year thereafter. There will be no fiscal impact on county and local expenditures or state, county and local revenue.

METHODOLOGY:

    The Department of Administrative Services states this bill changes the status of the Deputy Commissioner of the Department of Employment Security from a classified position to an unclassified position. Currently the incumbent Deputy Commissioner is a classified employee paid at labor grade 35, step 7, with a current annual salary at $81,939. This bill does not specify the new salary of the Deputy Commissioner under the unclassified salary scale, and therefore the Department cannot determine the fiscal impact of this change on expenditures. Also, there would be a fiscal impact on expenditures to the extent the incumbent has unpaid vacation time accrued at the point where he leaves the classified system.

    The Department of Employment Security states this bill changes the position of the Deputy Commissioner of the Department from classified to unclassified. The position is currently at labor grade 35 with a salary range between $62,712 and $85,235. This bill does not specify salary associated with the change of position from classified to unclassified. However, the Department anticipates the new unclassified salary range will approximate the current classified salary range. Funding for the Department, including salaries, is obtained from grants from the US Department of Labor, and a variety of state sources outside of the general fund.
