AN ACT relative to the recording of audio and video images on private property for security purposes.

This bill creates an exception to the violation of privacy and wiretapping and eavesdropping statutes to allow any person to conduct, without notice, audio or video recordings, or both, on his or her private property and curtilege for security purposes.

STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Seven
AN ACT relative to the recording of audio and video images on private property for security purposes.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 Violation of Privacy; Exception. Amend RSA 644:9, I(b) to read as follows:
(b) In any private place, any device for the purpose of observing, photographing, recording, amplifying, or broadcasting, or in any way transmitting images or sounds in such place; however a person may conduct, without notice, audio or video recordings, or both, on his or her private property and curtilege for security purposes; or
2 New Subparagraph; Wiretapping and Eavesdropping; Exceptions. Amend RSA 570-A:2, II by inserting after subparagraph (k) the following new subparagraph:
(l) Any person to conduct, without notice, audio or video recordings, or both, on such person’s private property and curtilege for security purposes.
3 Effective Date. This act shall take effect January 1, 2008.
