STATE OF NEW HAMPSHIRE

AN ACT relative to motor vehicle fines.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Repeal. 2006, 259, relative to reducing certain fines for motor vehicle violations, is repealed.

2 Effective Date. This act shall take effect upon its passage.

SB 126-FN-A - FISCAL NOTE

AN ACT relative to motor vehicle fines.

FISCAL IMPACT:

The Department of Safety and the Judicial Branch state this bill will increase state general fund revenue and increase state restricted revenue by an indeterminable amount FY 2008 and each year thereafter. The Department of Safety further states this bill will increase state highway fund expenditures by $79,000 in FY 2008. There will be no fiscal impact on county and local revenue or expenditures.

METHODOLOGY:

The Department of Safety states this bill repeals previously-enacted reductions in motor vehicle fines and changes the penalty assessment distribution percentages impacting the police standards and training council training fund, the victims’ assistance fund and the state general fund. The Department used information from the 2006 legislative session when the fines were increased. The Department states when the current fines were established, it was estimated they would decrease state general fund revenues by $5,000,000 per year, and decrease penalty assessment revenue by $1,000,000 per year. Penalty assessment revenue is currently split between the police standards and training council training fund (65%), the victim’s assistance fund (20%) and the general fund (15%). This bill is estimated to increase fines by these same amounts and would split penalty assessment revenue between the police standards and training council training fund (75%) and the victim’s assistance fund (25%). The estimated revenue impact is as follows:

The Department states there would also be an administrative cost to the state highway fund of approximately $79,000 to reprint and distribute new tickets.

The Judicial Branch estimated the penalty assessments collected by the Judicial Branch, using the first half of FY 2007 as a more accurate reflection of collections, and extrapolating them for the full year. The Branch estimates that pursuant to the proposed bill, state general fund revenue will decrease by $419,213 annually from fines collected by the Branch and revenue to the police standards and training council training fund will increase by $279,475 and revenue to the victim’s assistance fund will increase by $139,738.
