STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Seven

AN ACT relative to photo identification for persons released from correctional facilities.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Section; County Departments of Corrections; Photo Identification Upon Release. Amend RSA 30-B by inserting after section 24 the following new section:

30-B:25 Photo Identification Upon Release. Prior to the release of any inmate upon termination of his or her sentence, the superintendent of the county correctional facility in which the inmate is incarcerated and the department of safety shall provide a nondriver’s picture identification card pursuant to RSA 260:21 to the inmate for issuance upon release if the inmate does not already possess a valid driver’s license or nondriver’s picture identification card.

2 New Paragraph; Terms of Release. Amend RSA 651-A:6 by inserting after paragraph III the following new paragraph:

IV. Prior to the release of any inmate on parole, or upon termination of the inmate’s sentence, the commissioner and the department of safety shall provide a nondriver’s picture identification card pursuant to RSA 260:21 to the inmate for issuance upon release if the inmate does not already possess a valid driver’s license or nondriver’s picture identification card. The failure of the commissioner and the department of safety to provide the inmate with the required photo identification card prior to appearance before the parole board shall not constitute a cause for delaying of the inmate’s release on parole if approved.

3 New Paragraph; Identification Cards. Amend RSA 260:21 by inserting after paragraph X the following new paragraph:

XI. The department shall issue a nondriver’s picture identification card to inmates about to be released pursuant to RSA 30-B:25 and RSA 651-A:6, IV. The card need not bear the inmate’s new address if it is unknown prior to release.

4 Effective Date. This act shall take effect upon its passage.
