STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Seven

AN ACT requiring milfoil stickers for out-of-state boats.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Section; Milfoil Stickers. Amend RSA 270-E by inserting after section 9 the following new section:

270-E:9-a Milfoil Stickers.

I. A person may not place or operate a vessel exempt from registration pursuant to RSA 270-E:4, II on the waters of the state unless a valid milfoil sticker issued annually under this section is permanently affixed to each side of the bow above the water line and approximately 3 inches behind the vessel number or vessel registration sticker. A milfoil sticker is nontransferable.

II. A person who violates paragraph I shall be guilty of a violation and subject to a fine of not less than $100 and not more than $250 per violation.

III. The fee for a milfoil sticker is $20. Each agent shall retain $1 for each sticker sold by that agent for which a fee is required. All other revenue under this paragraph shall be distributed as follows: 1/2 shall be deposited in the fish and game fund and 1/2 shall be deposited in the navigation safety fund established in RSA 270-E:6-a.

2 Effective Date. This act shall take effect January 1, 2008.

SB 198-FN-A - FISCAL NOTE

AN ACT requiring milfoil stickers for out-of-state boats.

FISCAL IMPACT:

The Department of Safety has determined this bill may increase state restricted revenues and expenditures by an indeterminable amount in fiscal year 2008 and each year thereafter. There is no fiscal impact on county and local revenues or expenditures.

METHODOLOGY:

The Department states this bill requires milfoil stickers for all boats not registered in the state that wish to operate on state waters. The fee for the sticker is $20. $1 of the fee is to be retained by the issuing agent and the remainder is to be deposited in the amounts of 50% to the fish and game fund and 50% to the navigation safety fund. Violators are subject to a fine of not less than $100 and not more than $250 per violation. The Department is unable to estimate the amount of revenue that will result from registration fees and fines as they cannot determine the number of out-of-state boats that may be subject to this requirement, the number of milfoil stickers that might be issued, the number of violations that may occur, or the amount of the fine. The Department can not determine the fiscal impact on state expenditures because they are unable to estimate the number of stickers that will be required. If the number of stickers required is substantial the Department may not be able to absorb the costs within the existing budget.
