STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Seven

AN ACT establishing a commission to study the feasibility of establishing a public review board for health insurance rate increase requests.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Commission Established. There is established a commission to study the feasibility of establishing a public review board for health insurance rate increase requests.

2 Membership and Compensation.

I. The members of the commission shall be as follows:

(a) Two members of the senate, appointed by the president of the senate.

(b) Two members of the house of representatives, appointed by the speaker of the house of representatives.

(c) The insurance commissioner, or designee.

(d) One member representing the interests of large health insurance carriers, appointed by the governor.

(e) One member representing the interests of small health insurance carriers, appointed by the governor.

(f) One representative of the Business and Industry Association of New Hampshire, appointed by that organization.

(g) Three public members, appointed by the governor.

(h) One member from the Endowment for Health, appointed by that organization.

(i) One member from the New Hampshire Hospital Association, appointed by that organization.

II. Legislative members of the commission shall receive mileage at the legislative rate when attending to the duties of the commission.

3 Duties. The commission shall study the feasibility of establishing a public review board for health insurance rate increase requests.

4 Chairperson; Quorum. The members of the commission shall elect a chairperson from among the members. The first meeting of the commission shall be called by the first-named senate member. The first meeting of the commission shall be held within 45 days of the effective date of this section. Six members of the commission shall constitute a quorum.

5 Report. The commission shall report its findings and any recommendations for proposed legislation to the president of the senate, the speaker of the house of representatives, the senate clerk, the house clerk, the governor, and the state library. The commission shall make an interim report on November 1, 2007 and a final report on November 1, 2008.

6 Effective Date. This act shall take effect upon its passage.
