STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Seven

AN ACT making technical corrections to certain lottery commission provisions.

Be it Enacted by the Senate and House of Representatives in General Court convened:

112:1 Compensation; Audits. Amend RSA 284:21-d to read as follows:

284:21-d Compensation. Each member of the commission shall receive a salary [of $2,400 per year] in accordance with RSA 94:1-a, II and shall be allowed reasonable expenses, including transportation, incurred in the performance of the member’s duties [to be audited and allowed by the governor and council].

112:2 Bond. Amend RSA 284:21-c to read as follows:

284:21-c Bond. Members of the commission shall give bond to the state in such amount as shall be determined under the provisions of RSA [93:2 as amended by 1957, 296:1] 93-B.

112:3 Report of the Commission. Amend RSA 284:21-g to read as follows:

284:21-g Report of the Commission. The commission shall make an annual report to the governor [on or before the first day of February in each year] in accordance with RSA 20:7, including therein an account of its actions, receipts derived under the provisions of this subdivision, the practical effects of the application thereof, and any recommendation for legislation which the commission deems advisable.

112:4 Sale of Tickets; Advertising. Amend RSA 284:21-h, I(a) to read as follows:

(a) To conduct public drawings at such intervals and in such places within the state as the commission may determine. [If governor and council grant approval, such drawings may be in the form of pure lotteries and if so, shall not be associated in any way with a sporting event.] Such drawings may also be associated with horse or dog races or both as hereinafter provided. [At least one such drawing each year shall be based on a sweepstakes horse or dog race or both held within the state.]

112:5 Sale of Tickets; Advertising; Version Effective July 1, 2009. Amend RSA 284:21-h, I(a) to read as follows:

(a) To conduct public drawings at such intervals and in such places within the state as the commission may determine. [If governor and council grant approval, such drawings may be in the form of pure lotteries and if so, shall not be associated in any way with a sporting event.]

112:6 Sale of Tickets; Advertising. Amend RSA 284:21-h, I(c) to read as follows:

(c) To conduct both pure lotteries and horse or dog race or both [sweepstakes] lotteries if the commission[, with the approval of governor and council, shall determine] determines that such program will best accomplish the purposes of this subdivision.

112:7 Sale of Tickets; Advertising; Version Effective July 1, 2009. Amend RSA 284:21-h, I(c) to read as follows:

(c) To conduct pure lotteries if the commission[, with the approval of governor and council, shall determine] determines that such program will best accomplish the purposes of this subdivision.

112:8 Sale of Tickets; Advertising. Amend RSA 284:21-h, IV to read as follows:

IV. The lottery commission is authorized to advertise the sale of tickets at each sales location[. Any other advertising by the lottery commission of ticket sales will require prior approval of governor and council] and through other advertising media as the commission deems necessary to increase lottery sales.

112:9 Repeal. RSA 284:21-h, V, relative to the sale of sweepstakes tickets on Sunday at race tracks, is repealed.

112:10 Effective Date.

I. Sections 5 and 7 of this act shall take effect at 12:01 a.m. on July 1, 2009.

II. The remainder of this act shall take effect 60 days after its passage.
