STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Eight
AN ACT prohibiting sexual harassment in private postsecondary career schools.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 New Section; Postsecondary Education Commission; Regulation of Private Postsecondary Career Schools. Amend RSA 188-D by inserting after section 25 the following new section:
188-D:25-a Sexual Harassment Prohibited. Sexual harassment as defined in state and federal law shall be prohibited in all private postsecondary career schools. All private postsecondary career schools shall develop and enforce a policy prohibiting sexual harassment and shall publish such policy in the school’s policy handbook or other publication distributed to students. The policy shall detail the procedure for filing a claim and shall include a procedure for appealing an adverse decision to the postsecondary education commission. The executive director, in consultation with the postsecondary education commission, shall adopt rules, pursuant to RSA 541-A, relative to hearing appeals required under this section.
2 Effective Date. This act shall take effect 60 days after its passage.
