STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Eight
AN ACT requiring pharmacists to charge an insured person the usual and customary price or the copayment, whichever is less, of filling a prescription.
Be it Enacted by the Senate and House of Representatives in General Court convened:
29:1 New Section; Price of Filling Prescriptions. Amend RSA 318 by inserting after section 47-g the following new section:
318:47-h Price of Filling Prescriptions. A pharmacy benefits manager or insurer shall require a contracted pharmacy to charge an enrollee or insured person the pharmacy’s usual and customary price of filling the prescription or the contracted copayment, whichever is less.
29:2 Effective Date. This act shall take effect January 1, 2009.
