AN ACT requiring wrecker operators to make certain reports to the department of transportation.

ANALYSIS

This bill requires a wrecker operator to file a report with the department of transportation when the operator tows a vehicle that was involved in an accident, and the accident resulted in damage to state property on a way under the jurisdiction of the department of transportation.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Eight

AN ACT requiring wrecker operators to make certain reports to the department of transportation.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Section; Required Reporting by Wrecker Operator. Amend RSA 265 by inserting after section 154 the following new section:

265:154-a Required Reporting by Wrecker Operator. If a wrecker operator tows a vehicle that was involved in an accident, and the accident resulted in damage to state property on a way under the jurisdiction of the department of transportation, the operator shall file a report with the department of transportation within 48 hours of towing the vehicle. The report shall include:

I. The location of the accident, including the:

(a) Route number or street name.

(b) Distance from and name of the nearest intersecting road, bridge, or town line.

(c) City or town, and county.

(d) Relative distance to the nearest nodes or mile markers, if the accident occurred on an interstate highway.

II. The day, date, and time of accident, if known to the wrecker operator.

III. The day, date, and time the vehicle was towed by the wrecker operator.

IV. A description of the damage to state property observed by the wrecker operator, including, if possible, a photograph of the damage.

V. Identification of the owner and vehicle involved in the towing, including:

(a) Name of the owner.

(b) Owner’s address.

(c) The vehicle identification number.

(d) The make of the vehicle.

(e) The year of manufacture for the vehicle.

(f) The plate number and state where issued.

(g) The trailer plate number and state where issued, if applicable.

VI. An indication as to whether the accident involved:

(a) A commercial vehicle.

(b) Hazardous materials.

VII. The location to which the wrecker operator towed the vehicle.

VIII. The printed name and signature of the wrecker operator, and the date the report was signed.

2 Effective Date. This act shall take effect 60 days after its passage.
