AN ACT relative to the ability of towns to recoup money lent to homeowners upon foreclosure.

This bill provides that a property lien for assistance provided by the town to the property owner shall have priority over the mortgage and other liens filed with the register of deeds.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Eight

AN ACT relative to the ability of towns to recoup money lent to homeowners upon foreclosure.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Aid to Assisted Persons; Priority of Lien on Real Property. Amend RSA 165:30 to read as follows:

165:30 Relative Priority. Any lien arising under RSA 165:28 shall not be subordinate to mortgages and other valid liens, recorded with the register of deeds prior to the recording of the notice of the lien referred to in RSA 165:28.

2 Effective Date. This act shall take effect 60 days after its passage.

HB 1253-FN-LOCAL - FISCAL NOTE

AN ACT relative to the ability of towns to recoup money lent to homeowners upon foreclosure.

FISCAL IMPACT:

      The New Hampshire Municipal Association states local revenue may increase by an indeterminable amount in FY 2008 and each year thereafter. There will be no fiscal impact on state and county revenue or state, county, and local expenditures.

METHODOLOGY:

    The New Hampshire Municipal Association indicates this bill will provide that a property lien for welfare assistance shall have priority over the mortgage and other liens filed with the register of deeds. The Association states local revenue may increase by an indeterminable amount as welfare liens will be satisfied in the same way as a tax lien when property is foreclosed.
