STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Eight

AN ACT relative to the protection of existing property uses.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Section; Planning and Zoning; Land Use. Amend RSA 674 by inserting after section 19 the following new section:

674:19-a Land Use. All property openly and notoriously used, improved, altered, or built upon for a period of time 7 years or longer, for any purposes or activities thereof, whether such uses, improvements, alterations, or construction were permitted or not at that time, shall be deemed to be lawfully existing and exempt from all subsequent changes in regulations, ordinances, code, or any law so adopted by any city, town, or county in which there are located unincorporated towns or unorganized places, except those regulations and ordinances which expressly and directly protect public health standards, such as water quality and sewage treatment requirements. Such regulations or ordinances shall afford the property owner the opportunity to make any necessary changes and continue uninterrupted with property use protected by this section.

2 Effective Date. This act shall take effect 60 days after its passage.
