AN ACT relative to limiting games of chance.

AMENDED ANALYSIS

This bill limits games of chance to those types of games specifically authorized by the pari-mutuel commission.

This bill also raises the limit for which game operators may be reimbursed for out-of-pocket expenses.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Eight

AN ACT relative to limiting games of chance.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Games of Chance; Definition. Amend RSA 287-D:1 to read as follows:

II. “Games of chance’’ means any game involving gambling as defined by RSA 647:2, II, those games listed in RSA 287-D:2, VII or any lottery prohibited by RSA 647:1, but shall not include any game involving the use of a slot machine or any other device in the nature of a slot machine, 50/50 raffles as defined in RSA 287-A:1, III, or ice-out contests as defined in RSA 287-D:1, IV.

2 New Paragraph; Rulemaking; Games of Chance. Amend RSA 287-D:1-b by inserting after paragraph VI the following new paragraph:

VI-a. Game rules for each authorized game of chance. In adopting rules under this paragraph, the pari-mutuel commission may incorporate by reference rules and regulations of other state agencies relative to games of chance rules.

3 New Paragraphs; Games of Chance Authorized. Amend RSA 287-D:2 by inserting after paragraph VI the following new paragraphs:

VII. Only games of chance expressly authorized by statute shall be permitted. The following games of chance are authorized:

(a) Texas Hold `Em and all other poker games.

(b) Roulette.

(c) Black Jack.

(d) Craps.

(e) Chuck-A-Luck.

(f) Spinning Money Wheel.

VIII. The proceeds that a charitable organization receives from conducting games of chance shall be used to benefit the community or communities which it serves, consistent with the purpose for which the charitable organization was formed.

4 License Applications. Amend RSA 287-D:1, III (a)(2) to read as follows:

(2) Establish that the purposes for which it was organized, other than charitable gambling, are furthered through charitable activities conducted [in the town or city in which the games of chance are conducted] in the community or communities which the charitable organization serves.

5 License Applications. Amend RSA 287-D:2-a, VII(b) to read as follows:

(b) Establish that the religious, civic, fraternal, veterans, or charitable purposes for which it was organized, other than charitable gambling, are furthered [through activities conducted in the town or city in which the charitable organization is organized] in the community or communities which the charitable organization serves by conducting games of chance as authorized under this chapter.

6 Compensation of Game Operators. Amend RSA 287-E:7, II to read as follows:

II. No compensation shall be paid to operators of a bingo game. Compensation shall include, but is not necessarily limited to, money or any other thing of value. Operators of bingo games may be reimbursed for their out-of-pocket expenses in an amount not to exceed [$25] $60 per game date, provided that such expenses are itemized and submitted in writing to the charitable organization.

7 Effective Date. This act shall take effect January 1, 2009.
