STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Eight

AN ACT establishing a commission to promote the celebration of Martin Luther King, Jr. Civil Rights Day.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Subdivision; Martin Luther King, Jr. Civil Rights Day Commission. Amend RSA 354-B by inserting after section 6 the following new subdivision:

Martin Luther King, Jr. Civil Rights Day Commission

354-B:7 Commission Established. There is established a commission to promote the annual celebration of Martin Luther King, Jr. Civil Rights Day in New Hampshire.

354-B:8 Membership and Compensation.

I. The commission shall consist of the following members:

(a) Three members appointed by the speaker of the house of representatives, only one of whom may be a member of the legislature.

(b) Three members appointed by the president of the senate, only one of whom may be a member of the legislature.

(c) Three members appointed by the governor, only one of whom holds an elected position in state government.

(d) One member appointed by each executive councilor, who shall not hold an elected position in state government.

II. Members shall serve without compensation except that legislative members of the commission shall receive mileage at the legislative rate when attending to the duties of the commission. The members of the commission shall elect a chairperson and a vice-chairperson from among the members. The first meeting of the commission shall be called by the first-named member appointed by the speaker of the house of representatives. The first meeting of the commission shall be held within 45 days of the effective date of this section. Eight members of the commission shall constitute a quorum.

III. Members shall serve a term concurrent with the term of the appointing authority. Vacancies shall be filled in the same manner as the original appointment. Members shall serve until a replacement is named. Commission members may be reappointed.

IV. The commission shall meet at least 3 times per year and may hire staff as the commission determines is necessary. The commission may accept gifts or donations to defray the cost of its activities.

354-B:9 Duties. The commission shall:

I. Promote the annual celebration of Martin Luther King, Jr. Civil Rights Day in New Hampshire.

II. Promote diversity throughout New Hampshire, including working with schools, city and town governments, state employees, institutions within the university system of New Hampshire and the community college system of New Hampshire, and cultural, private, and non-profit organizations in coordinating and promoting annual and year-round activities and events focusing on diversity.

354-B:10 Report. Beginning November 1, 2008, and annually thereafter, the commission shall submit a report detailing its activities and making recommendations concerning diversity-related issues to the speaker of the house of representatives, the president of the senate, the house clerk, the senate clerk, the governor, and the state library.

2 Effective Date. This act shall take effect upon its passage.
