AN ACT relative to amending zoning ordinances at official ballot town meetings.

This bill clarifies that zoning warrant articles proposed by the planning board or board of selectmen may be amended at the first session of an official ballot town meeting.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Eight

AN ACT relative to amending zoning ordinances at official ballot town meetings.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Official Ballot Town Meeting; First Session; Limitations on Amending Warrant Articles. Amend RSA 40:13, IV(a) to read as follows:

(a) Warrant articles whose wording is prescribed by law shall not be amended. The wording of amendments to the zoning ordinance proposed by the planning board or the board of selectmen shall not be considered prescribed by law.

2 Planning and Zoning; Method of Enactment. Amend RSA 675:3, III to read as follows:

III. After the public hearing the planning board shall, by vote, determine the final form of the ordinance, amendment, or amendments to be presented to the town or village district, which ordinance or amendment may include editorial revisions and textual modifications resulting from the proceedings of that hearing. In towns that have adopted the official ballot form of town meeting under RSA 40:13, the legislative body may amend the ordinance, amendment, or amendments presented by the planning board at the deliberative session.

3 Effective Date. This act shall take effect 60 days after its passage.
