STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Eight

AN ACT relative to access to voter information.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Access to Statewide Voter Information. Amend RSA 654:46 to read as follows:

654:46 [Party] Access to Statewide Voter Information.

I. Notwithstanding any other provision of law, the secretary of state shall, upon request, provide to a party, as defined in RSA 652:11, or to any other person a list of the name, street address, mailing address, town or city, gender, year of birth, voter history, and party affiliation, if any, of every registered voter in the state. In this section, “voter history” means the elections at which the voter voted. The secretary of state may charge a fee of up to $25 plus $0.50 per thousand names or portion thereof in excess of 2,500 plus shipping charges for each copy of the list provided under this section. The secretary of state may provide lists as prescribed in this section on paper, computer disk, computer tape, electronic transfer, or any other form. Fees collected by the secretary of state under this section shall be deposited in the election fund established pursuant to RSA 5:6-d.

II. No party or any other person shall use or permit the use of voter information provided by the secretary of state under paragraph I for commercial purposes as defined in RSA 654:31, I(b). Whoever knowingly violates any of the provisions of this section shall be guilty of a misdemeanor if a natural person or guilty of a felony if any other person.

III. In this section, “any other person” means any citizen of the state over 18 years of age who is not engaged in the business of selling lists for commercial purposes.

2 Effective Date. This act shall take effect upon its passage.
