AN ACT establishing an arboviral illness task force and relative to mosquito control and abatement.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Eight

AN ACT establishing an arboviral illness task force and relative to mosquito control and abatement.

Be it Enacted by the Senate and House of Representatives in General Court convened:

73:1 New Paragraph; Eligibility for Mosquito Control Fund Reimbursement Clarified. Amend RSA 141-C:25 by inserting after paragraph IV the following new paragraph:

IV-a. Following a determination of eligibility under paragraph IV, the city, town, or mosquito control district shall be eligible for funding for mosquito control and abatement activities occurring during the same calendar year prior to or after a determination of a public health threat under paragraph III.

73:2 Rulemaking. The department of agriculture, markets, and food shall review its rules relating to the implementation of mosquito control and abatement activities and may initiate rulemaking if it finds that the reorganization, integration, augmentation, or clarification of these rules is in the public interest.

73:3 Arboviral Illness Task Force Established.

I. There is established an arboviral illness task force.

II. The members of the task force shall be as follows:

(a)) The state epidemiologist, or designee.

(b) The state veterinarian, or designee.

(c) The state entomologist, or designee.

(d) The director of public health laboratories, department of health and human services, or designee.

(e) The director of the New Hampshire veterinary diagnostic laboratory, at the university of New Hampshire, or designee.

(f) An entomologist from the university of New Hampshire, designated by the commissioner of health and human services.

(g) A representative of the department of education, designated by the commissioner of education.

(h) A representative of the department of resources and economic development, designated by the commissioner of resources and economic development.

(i) A representative of the fish and game department, designated by the executive director of the fish and game department.

(j) A representative of the department of environmental services, designated by the commissioner of environmental services.

(k) Two local public health officers or regional public health network coordinators, designated by the commissioner of health and human services.

(l) The state public health veterinarian, or designee.

III. The task force shall serve without compensation and may solicit any information from any person or entity the task force deems relevant to its purpose.

IV. The committee shall review current knowledge and address future needs of arboviral ecology, disease, prevention, and control in New Hampshire so that accurate and timely information can be used to guide personal, local, and state responses to these diseases.

V. The commissioner of health and human services shall appoint a chairperson from among the members. The first meeting of the task force shall be called by the chairperson. Seven members of the task force shall constitute a quorum.

VI. The task force shall report its findings and any recommendations to the commissioner of the department of health and human services on a regular basis as determined by the commissioner of the department of health and human services.

73:4 Duties of State Committee on Mosquito Control Revised. Amend RSA 430:10 to read as follows:

430:10 State Committee. There is established a state committee on mosquito control to govern over the 6 regions of the state and their respective mosquito control districts. The committee is composed of the state entomologist, the executive director of the fish and game department, the director of the division of forests and lands, the director of the division of parks and recreation, the commissioner of the department of environmental services, the commissioner of the department of health and human services, and [the pesticides inspector employed by the pesticides] a representative of the pesticide control board. Any member may be represented by a deputy or by some other person designated by the member, in writing. The committee shall provide oversight and coordination of interagency efforts with regard to mosquito prevention and control, and in particular to provide recommendations to the commissioner of the department of health and human services regarding, but not limited to, public health threat determinations under RSA 141-C:25. The members of the committee shall serve without salary, but may be reimbursed for expenses incurred while doing the work of the committee. The state committee shall be known in this subdivision as “the committee.” The division of public works of the department of transportation, known in this subdivision as “the department”, shall serve as the fiscal agent for the committee. The functions of the department in this respect shall be performed by a member of the division designated by the commissioner of transportation.

73:5 Effective Date. This act shall take effect 60 days after its passage.
