STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Eight

AN ACT relative to negotiations between public employers and employees.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Paragraph; Binding Arbitration. Amend RSA 273-A:3 by inserting after paragraph IV the following new paragraph:

V. If parties are unable to reach an agreement 30 days before the budget is due, the parties shall seek and contract for binding arbitration services of a nationally recognized conciliation or arbitration provider. The arbitrator and party representatives shall make a fair and reasonable determination of the matters in dispute. The arbitrator and party representatives shall have the authority to act on each disputed issue and choose an equitable solution. Such decisions of the arbitrator and party representative shall be final and binding and shall supersede any otherwise applicable dispute resolution procedure provided by law. Costs shall be paid by the losing party.

2 Effective Date. This act shall take effect 60 days after its passage.
