STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Eight
AN ACT exempting alternative and renewable fuels from the road toll.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 New Section; Motor Vehicles; Words and Phrases Defined; Biodiesel. Amend RSA 259 by inserting after section 6 the following new section:
259:6-a Biodiesel. “Biodiesel” shall mean a renewable diesel fuel substitute that is composed of mono-alkyl esters of long chain fatty acids, is derived from vegetable oils or animal fats, and meets the requirements of the American Society for Testing and Materials (ASTM) specification D6751.
2 New Paragraph; Road Tolls; Levy of Tolls and Exemptions; Alternative and Renewable Fuels. Amend RSA 260:32 by inserting after paragraph VI the following new paragraph:
VII. Sales of alternative and renewable fuels, including but not limited to:
(a) Vegetable oil.
(b) Waste vegetable oil.
(c) Biodiesel or any blend of biodiesel with petroleum-based diesel fuel, where at least 20 percent of the blend by volume is biodiesel.
(d) Alcohol.
3 Effective Date. This act shall take effect July 1, 2008.

HB 1355-FN - FISCAL NOTE
AN ACT exempting alternative and renewable fuels from the road toll.
FISCAL IMPACT:
The Department of Safety states this bill will decrease state highway fund revenue and expenditures and decrease local revenue by an indeterminable amount in FY 2009 and each fiscal year thereafter. There will be no fiscal impact on county and local expenditures or county revenues.
METHODOLOGY:
The Department of Safety states this bill exempts alternative and renewable fuels, including biodiesel, from the road toll and changes the definition for biodiesel to use the American Society for Testing and Material (ASTM) specification D6751. Alternative fuels that would be exempt from the $.18 road toll include vegetable oil, waste vegetable oil, biodiesel or any biodiesel blend equal to or greater the 20%, and alcohol. The state has approximately 180 biodiesel licensed motor fuel distributors that would be able to use this exemption. The Department cannot estimate either how many of these distributors would take advantage of this exemption or the corresponding decrease in highway fund revenue from road toll.
This decrease in highway revenue will also decrease highway expenditures and local revenue for the 12% local government apportionment that the Department of Transportation distributes based on the preceding fiscal year revenues in accordance with RSA 235:23.
