STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Eight

AN ACT relative to custom vehicles.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Section; Motor Vehicles; Words and Phrases Defined; Custom Vehicle. Amend RSA 259 by inserting after section 17 the following new section:

259:17-a Custom Vehicle.

I. “Custom vehicle” shall mean any motor vehicle that:

(a) Is at least 25 years old and of a model year after 1948, or was manufactured to resemble a vehicle 25 or more years old and of a model year after 1948; and

(b) Has been altered from the manufacturer’s original design, or has a body constructed from non-original materials.

II. The model year that is listed on the certificate of title of a custom vehicle shall be the model year that the body of such vehicle resembles.

2 New Section; Number Plates for Vehicles Registered as Custom Vehicles. Amend RSA 261 by inserting after section 89-c the following new section:

261:89-d Number Plates for Vehicles Registered as Custom Vehicles.

I. For each custom vehicle, there shall be a one-time registration fee of $25.

II.(a) In applying for registration of a custom vehicle under this section, the owner of the custom vehicle shall submit with the application a certification that the vehicle for which the application is made:

(1) Will be maintained for occasional transportation, exhibitions, club activities, parades, tours, and similar uses; and

(2) Will not be used for general daily transportation.

(b) In addition to the certification required under subparagraph II(a), when applying for registration of a custom vehicle, the new owner of the custom vehicle shall provide proof acceptable to the director that the custom vehicle passed a safety inspection that has been approved by the director in consultation with the custom vehicle community in this state.

III. On registration of a vehicle under this section, the director shall issue a special custom vehicle registration plate of the size and design that the director determines in consultation with the custom vehicle community in this state.

3 New Subdivision; Custom Vehicles. Amend RSA 266 by inserting after section 114 the following new subdivision:

Custom Vehicles

266:115 Equipment Required of Custom Vehicles.

I. Unless the presence of the equipment was specifically required by a statute of this state as a condition of sale in the year listed as the year of manufacture on the certificate of title, the presence of any specific equipment is not required for the operation of a vehicle registered as a custom vehicle.

II. A vehicle registered as a custom vehicle is exempt from any statute that requires periodic vehicle inspections and from any statute that requires the use and inspection of emission controls.

III. A custom vehicle may use blue dot tail lights for stop lamps, rear turning indicator lamps, rear hazard lamps, and rear reflectors. “Blue dot tail light” means a red lamp installed in the rear of a motor vehicle containing a blue or purple insert that is not more than one inch in diameter.

4 Effective Date. This act shall take effect January 1, 2009.

HB 1358-FN - FISCAL NOTE

AN ACT relative to custom vehicles.

FISCAL IMPACT:

      The Department of Safety states this bill will increase state restricted highway fund revenue by $7,350, increase state restricted highway fund expenditures by $46,242, and decrease local revenue by $688 in FY 2009, decrease local revenue by $1,500 in FY 2010, decrease state restricted highway fund revenue by $750 and local revenue by $1,590 in FY 2011, and decrease local revenue by $1,500 in 2012. There is no fiscal impact on county revenue or county and local expenditures.

METHODOLOGY:

    The Department of Safety indicates this bill will establish a one-time registration fee of $25 and equipment requirements for custom vehicles. The Department estimates 300 vehicles will fall under the custom vehicle definitions. The Department estimates the following impact on Highway Fund revenue in FY 2009:

    The Department states local revenue from the 12 percent apportionment per RSA 235:23 will increase by $812 ($7,350 * 12% per RSA 235:23 apportionment) in FY 2009 but decrease in FY 2011 by $90 due to the loss of inspection sticker revenue ((300 vehicles * $2.50 fee) * 12% per RSA 235:23 apportionment). The loss of the municipal fee for registrations completed locally will decrease local revenue by $1,500 (300 vehicles * $5 municipal fee) in FY 2009 and each year thereafter. The net impact on local revenue is as follows:
